Today, the UK Supreme Court ruled that certain claims brought by Tesla relating to the Avanci 5G Vehicle program should proceed to trial before the High Court. The Court’s decision concerns whether those claims should be considered following a full evidentiary trial and does not determine the merits of Tesla’s claims.

Avanci respectfully disagrees with today’s decision and continues to believe Tesla’s claims are without merit.

Avanci’s 5G Vehicle program is an optional, market-driven licensing solution adopted by more than 90 participating licensors holding the vast majority of the 5G/4G patents essential for cellular connected vehicles and over 100 automotive brands selling most of the 5G/4G connected vehicles worldwide. Every participating automaker licenses on the same transparent, publicly available commercial terms, creating a global level playing field for the industry.

Today’s ruling does not determine whether Tesla’s attempt to pay less than the widely adopted global price for an Avanci license will ultimately succeed, nor does it change the terms of the Avanci 5G Vehicle program or any existing license agreements.

We remain confident that, when the matter is fully considered by the High Court, it will confirm what the marketplace has already demonstrated: Avanci provides an optional, fair and efficient licensing solution that benefits both the automotive and telecom industries.
